SWEEPSTAKES RULES
1. NO PURCHASE NECESSARY TO PLAY OR WIN. THE PURCHASE OF ANY GOOD AND/OR SERVICE WILL NOT INCREASE AN ENTRANT’S CHANCE OF WINNING. This sweepstakes is sponsored by Gerber Childrenswear LLC and GC Brands, LLC (collectively referred to as “Sponsor”). The sweepstakes entry period starts on April 10, 2009 at 12:00 a.m. Central Daylight Time ("CDT") and ends on June 30, 2009 at 11:59 p.m. CDT. Mailed entries must be postmarked on or before June 30, 2009 and e-mail entries must be received by 11:59 PM CDT on June 30, 2009. Eligibility for entry into the sweepstakes will cease at the applicable time and date and all entries received thereafter will be considered disqualified and will be ineligible for participation. If Sponsor does not receive your entry for any reason, including without limitation those specified below, or if your entry is not entered correctly, the entry will be invalid and you will be ineligible for the prize.
2. ELIGIBILITY: ONLY LEGAL RESIDENTS, WHO ARE 18 YEARS OF AGE OR OLDER, OF THE 50 U.S. STATES AND THE DISTRICT OF COLUMBIA ARE ELIGIBLE TO PLAY OR WIN, EXCEPT FOR THOSE STATES WHERE THIS SWEEPSTAKES IS PROHIBITED BY LAW. Neither Sponsor nor any of its affiliates warrants that this sweepstakes is valid in any particular jurisdiction. Residents of jurisdictions where this sweepstakes is prohibited are ineligible to compete in the sweepstakes. Each participant can enter only once. If multiple entries are submitted by any person, only the first entry received by Sponsor (as determined by the Sponsor) will be entered into the sweepstakes. Accordingly, each entry must include the name and mailing address or e-mail address of the participant. In the event of a dispute, an e-mail entry will be deemed to have been submitted by the owner of the e-mail account from which it was sent. For these purposes, an e-mail account owner shall mean the natural person assigned to such e-mail account by the Internet access provider, online service provider or other organization responsible for assigning e-mail addresses for the domain associated with such e-mail account. Employees of Sponsor, or any of their affiliates, subsidiaries, retailers, advertisers, advertising and promotion agencies, or any company retained by Sponsor to promote, administer or provide advice with respect to the sweepstakes (and their respective affiliates), and members of any of their immediate families are not eligible to enter.
3. PRIZES: (Ten (10) Grand Prizes): The ten (10) Grand Prizes shall consist of Lamaze® and Gerber® apparel, toys and/or bodycare products, valued at approximately $200 retail.
The winners of the sweepstakes will be selected by random drawing within fifteen (15) days after June 30, 2009, from all eligible entries received for the drawing. The winner will be required to sign and return an affidavit of eligibility, liability release, and publicity release (where legal) within fourteen (14) days of prize notification. In the event of non-compliance with any of the rules set forth herein, or any prize notification returned as undeliverable, the winner’s prize may be forfeited and awarded to an alternate winner. Sponsor is not responsible for, and shall not be liable for, late, lost, misdirected or unsuccessful efforts to notify the winners. A maximum of one winner per household will be awarded per calendar year. Decisions of the Sponsor are final on all matters relating to this sweepstakes.
The reporting and payment of all tax liabilities incurred by any winner as a result of the sweepstakes are the sole responsibility of the winner. All federal, state, and local laws and regulations apply. Prizes are awarded “AS IS” and WITHOUT WARRANTY OF ANY KIND, expressed or implied, including, without limitation, any implied warranty of merchantability or fitness for a particular purpose. No substitution of prizes will be permitted, except by Sponsor, who may substitute a prize of equal or greater value if the advertised prize becomes unavailable. Prizes are non-transferable and may not be redeemed for cash. Odds of winning will be dependent upon number of entries received.
4. ENTRY: There are two ways to enter, either by (1) visiting the Sponsor’s website (www.gcbrandsllc.com) and submitting your entry by clicking on the “Enter Now” button as required; or (2) entering by mail by printing your name, address, daytime telephone number and e-mail address, age, city of residence, state of residence, relationship to baby, baby’s age, and whether or not you desire to receive any further information from Gerber Childrenswear LLC regarding its products or promotions to: Lamaze Sweepstakes Entry, 7005 Pelham Road, Suite D, Greenville, SC 29615. A mail-in entry will be treated in the same manner as an entry received through the website. Sponsor reserves the right at its sole discretion to reject any request of entry.
5. SWEEPSTAKES WINNERS: The names of any winners may be posted at Sponsor’s website (www.gcbrandsllc.com), and the identity of the winners can also be obtained by writing to Gerber Childrenswear LLC, Attn: Marketing, 7005 Pelham Rd., Suite D, Greenville, SC 29615. The winners will be notified via certified mail, return receipt requested and/or by e-mail within approximately seven (7) days of choosing.
6. GENERAL: These rules may be obtained at the Sponsor’s website or by sending a self-addressed stamped envelope to: Gerber Childrenswear LLC, Attn: Marketing, 7005 Pelham Rd., Suite D, Greenville, SC 29615 within thirty (30) days of the sweepstakes’ deadline date. Residents of Vermont may omit return postage. Questions regarding this sweepstakes may be sent to Gerber Childrenswear LLC, Attn: Marketing, 7005 Pelham Rd., Suite D, Greenville, SC 29615. By entering the sweepstakes, entrants agree to these rules and all eligibility requirements and all decisions of Sponsor. By accepting a prize, winners agree that the Sponsor and those acting under the Sponsor’s authority, may use winners' names, biographical information, pictures/portraits, likenesses and/or voices, for advertising and promotional purposes without further consideration at the sole discretion of Sponsor, unless prohibited by law. BY ACCEPTING A PRIZE, WINNERS AGREE THAT THE SPONSOR, ITS PARENT COMPANY, AFFILIATED COMPANIES, AGENTS, RETAILERS, ADVERTISING AND PROMOTION AGENCIES, AND ALL OF THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS, WILL HAVE NO LIABILITY WHATSOEVER FOR, AND WILL BE HELD HARMLESS BY WINNERS FOR ANY LIABILITY, INJURY, LOSS OR DAMAGE OF ANY KIND, INCLUDING DEATH, TO PERSONS AND PROPERTY, DUE IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM THE ACCEPTANCE, POSSESSION, USE OR MISUSE OF THE PRIZE OR PARTICIPATION IN THIS SWEEPSTAKES. All entries become the sole property of Sponsor and none will be returned. If for any reason the sweepstakes is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure, human error or any other causes beyond the control of Sponsor that corrupt or affect the administration, security, fairness, integrity, or proper conduct of the sweepstakes, Sponsor reserves the right, in its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the sweepstakes and award prizes from among all eligible entries received prior to cancellation or termination. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, mail delivery error or delay, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. The Sponsor is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by Sponsor on account of technical problems or traffic congestion on the Internet or at any website, any combination thereof, or otherwise, including any injury or damage to entrant's or any other person's computer related to or resulting from participation or downloading any materials in the sweepstakes. CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM OR CRIMINAL SANCTIONS AGAINST ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
Notwithstanding any rule herein, an entrant has the right to refuse to provide personal information to Sponsor in accordance with any applicable laws. Should a sweepstakes winner refuse to provide a mailing address to Sponsor, the winner’s prize may be forfeited and awarded to an alternate winner. Before providing any personal information, please read our Privacy Policy, which is available at www.gcbrandsllc.com, or can be obtained by requesting it from Gerber Childrenswear LLC, Attn: Marketing, 7005 Pelham Rd., Suite D, Greenville, SC 29615. By submitting a completed entry form, you consent to the collection, processing, use and disclosure of the information contained in your entry form according to our Privacy Policy.
Right of Non-Participation: Pursuant to federal law, any individual has the right to notify the Sponsor that he/she does not wish to be contacted by the Sponsor regarding any future sweepstakes or contest or mailings and that Sponsor may not use any information provided to it by such individual for any purposes other than as needed for this sweepstakes. The Sponsor may be so notified by mail at Gerber Childrenswear LLC, Attn: Marketing, 7005 Pelham Rd., Suite D, Greenville, SC 29615.
If no entrant qualifies for any prize to be awarded pursuant to this sweepstakes, then the prize or its equivalent cash value may be awarded to a charity of the Sponsor’s choice.
Sponsor reserves the right to verify the eligibility qualifications of winners. This sweepstakes is governed by U.S. and applicable law. By entering the sweepstakes (or pressing the submit button for e-mail transmission) you have agreed to all the rules and conditions of the sweepstakes as set forth herein.
